Terms & Condition

Last updated: November 23, 2020

These Terms of Use are an agreement between you and Nick & Joe’s (“we,” “us,” or “our”) that applies to your use of our website, mobile site, and any related services or features (together, the “Site”). By accessing or using the Site, you confirm that you understand these terms and agree to follow them. If you do not agree, please do not use the Site.

We may update these Terms from time to time. When we do, we will change the “Last updated” date above. It is your responsibility to review this page occasionally so you stay informed. Continuing to use the Site after changes are posted means you accept the updated Terms.

The Site is intended for users age 13 and older. If you are under 18, you should use the Site only with permission and supervision of a parent or guardian. The Site is not designed to comply with certain industry-specific rules (such as HIPAA). Please do not use the Site in a way that would violate any laws or regulations that apply to you.

Unless stated otherwise, the Site and everything on it (including text, images, menu content, designs, logos, and code) is owned by Nick & Joe’s or used with permission and is protected by intellectual property laws. You may use the Site for personal, non-commercial use only. You may not copy, reproduce, resell, distribute, or exploit any part of the Site or content without written permission from us.

If you create an account or submit information through the Site, you agree the information you provide will be accurate and kept up to date. You are responsible for keeping your login credentials secure and for activity under your account. We may remove or change usernames we consider inappropriate.

You agree not to misuse the Site. This includes attempting to access data you are not authorized to access, interfering with security features, using bots or scraping tools, uploading harmful code, spamming, impersonating others, harassing people, posting unlawful content, or using the Site for any unauthorized commercial purpose. We may restrict access, suspend accounts, or remove content if we believe the Site is being used in a way that violates these Terms or the law.

If the Site allows you to submit content (such as reviews, comments, or other materials), you are responsible for what you post. You may only submit content that you have the right to share and that does not violate anyone’s rights or the law. If you post content to the Site, you grant Nick & Joe’s permission to use, display, and share that content in connection with operating and promoting the Site and our services. We may edit or remove user-submitted content at any time.

If you leave a review, it should be honest and based on your own experience, and it must not include offensive, discriminatory, or unlawful content. We may remove reviews at our discretion.

The Site may include links to third-party websites or services. We are not responsible for third-party content, policies, or practices. If you choose to visit third-party sites, you do so at your own risk and should review their terms and privacy policies.

We care about privacy. Please review our Privacy Policy for details on how we collect, use, and protect information. Our Site is hosted in the United States, and by using it you understand that your information may be processed there.

We may change, pause, or discontinue any part of the Site at any time, and the Site may occasionally be unavailable due to maintenance or technical issues.

The Site is provided “as is” and “as available.” To the extent permitted by law, Nick & Joe’s disclaims warranties of any kind and is not responsible for damages that result from use of the Site, including interruptions, errors, or third-party issues. Where the law limits these disclaimers, your rights remain protected as required.

If you violate these Terms, we may suspend or terminate your access to the Site. These Terms are governed by applicable state law, and any disputes will be handled under the process allowed by law, which may include informal resolution steps and, where applicable, arbitration.
